Terms and Conditions

I. General

Nesmuk GmbH & Co. KG (hereinafter "Seller") operates an online store for kitchen knives on its website. These General Terms and Conditions (T&Cs) apply to all business relations between the Seller and the customer in the version valid at the time of conclusion of the contract.

II. Contract Conclusion

  1. The product presentations of the Seller on the Internet do not represent a binding offer to conclude a purchase contract, but rather an invitation to place an order.
  2. The customer can select products from the Seller's assortment and collect them in a shopping cart. By clicking the "Buy" button, the customer submits a binding offer to purchase the goods in the shopping cart.
  3. The Seller can accept the offer of the customer within five days.

III. Prices and Payment

  1. All prices stated on the Seller's website are quoted in US dollars and include the applicable statutory sales tax.
  2. The customer can make payment via PayPal, credit card, Apple Pay, Google Pay.

IV. Delivery, Product Availability

  1. Delivery times stated by us are calculated from the time of our order confirmation, provided prior payment of the purchase price.
  2. If the product specified by the customer in the order is only temporarily unavailable, the Seller will also immediately inform the customer. In the event of a delivery delay of more than two weeks, the customer has the right to withdraw from the contract.

V. Shipping Costs

  1. For orders under $150, the flat-rate shipping cost is $6.
  2. Delivery is free of charge for orders of $150 or more.

VI. Retention of Title

Until full payment has been made, the delivered goods remain the property of the Seller.

VII. Return and Refund Policy

The customer has the right to revoke the contract within fourteen days without giving reasons. The revocation period begins from the day on which the customer or a third party designated by him, who is not the carrier, has taken possession of the goods.

VIII. Liability

Unless otherwise follows from below, further claims of the customer - regardless of the legal grounds - are excluded. The Seller is therefore not liable for damages that did not occur on the delivery item itself; in particular, the Seller is not liable for lost profits or other financial losses of the customer.

IX. Privacy

X. Applicable Law

The law of the United States of America shall apply to all legal relations of the parties, excluding the laws on the international purchase of movable goods.
